These Terms of Use permit only your personal use of the Website. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any of the material on our Website without our prior written consent. If you print, copy, modify, download or otherwise use or provide any other person with access to any part of the Website in breach of the Terms of Use, your right to use the Website will cease immediately. No right, title or interest in or to the Website or any content on the Website is transferred to you, and all rights not expressly granted are reserved by the Company.

The Company name, the term “eCom Label Solutions”, the Company logo and all related names, logos, product and service names, designs and slogans are trademarks of the Company or its affiliates or licensors. You must not use such marks without the prior written permission of the Company. All other names, logos, product and service names, designs and slogans on this Website are the trademarks of their respective owners.

Order Acceptance.  You agree that any order you make through the Website is an offer to buy all of the products listed in your order. All orders must be accepted by us or we will not be obligated to sell the products to you. We may choose not to accept any orders in our sole discretion. After having received your order, we will send you a confirmation e-mail with your order number and details of the items you have ordered (each a “Confirmation Email”).

Shipments; Delivery.  We will ship any products you order on the Website to you. Please check the individual product page for specific delivery options.  You will pay all shipping and handling charges specified during the ordering process.  Title and risk of loss pass to you upon our transfer of the products to the carrier.  Shipping and delivery dates are estimates only and cannot be guaranteed.  We are not liable for any delays in shipments.

Goods Not for Resale or Export. You represent and warrant that you are buying products or services from the Website for your own use only, and not for resale or export.

Custom Products.  You acknowledge and agree that neither the Company nor any other party connected with the manufacture of products ordered through the Website will be responsible for the design of your order when you give final approval of the proof. You must evaluate and bear all risks associated with the design of your order and any custom content or images used in your order. You are solely responsible for and assume all liability arising from all products that you create or use in connection with the Website. The fact that we produce any custom product does not mean that: (1) we approve or endorse the content of the custom product, (2) the custom product complies with all applicable laws, or (3) you will not incur any liability or harm arising from the custom product. IF YOU RECEIVE ANY PRODUCTS THAT DO NOT CONFORM TO YOUR ORDER AND THE CONFIRMATION EMAIL, WE MAY REPLACE YOUR ORDER WITH CONFORMING PRODUCTS OR REFUND THE PURCHASE PRICE AT OUR SOLE DISCRETION. OUR LIABILITY FOR NONCONFORMING PRODUCTS WILL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR PRODUCTS YOU HAVE PURCHASED THROUGH THE WEBSITE.

All matters relating to the Website and these Terms of Use and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Washington without regards to that state’s choice of law rules.  Any legal suit, action or proceeding arising out of, or related to, these Terms of Use or the Website shall be instituted exclusively in the federal courts of the United States or the courts of the State of Washington, in each case located in the City of Seattle.  You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts

No waiver of by the Company of any term or condition set forth in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.

These Terms of Use and, with respect to each order placed through the Website, the terms of the respective Confirmation Email constitute the sole and entire agreement between you and the Company with respect to the Website and products ordered through the Website and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the Website.

The eCom Label stock has been customized for eCom Label Solutions. It has been formulated for application on apparel bags and corrugated boxes. For best results, store your labels in a dry location between 60°-75°F. Do not place labels over seams, folds or wrinkles. Press all edges of labels down firmly. Only apply to clean and dry surfaces.

We recommend testing the eCom Label on your packages for adhesive strength before implementation, especially if you are using recycled corrugated boxes. Recycled corrugates often contain contaminates such as glue, ink and wax making label adhesion more challenging. In addition, corrugate suppliers sometimes change the composition of box materials without notice. We are not responsible for these changes. Please contact us if you would like samples for testing.

eCom labels are custom printed per your specifications. Please review carefully before signing off on any proofs. Labels are not returnable for credit on errors in copy once proofs have been approved
